Since the possession and use of dagga products on private property has been legalised, there has been much discussion on social media and elsewhere about the negative effect it has on fellow residents in Sectional Title Schemes.

One should refer to Section 13 of the Sectional Title Schemes Management Act which states that an owner must not use or allow a section or exclusive use are to be used so as to cause a nuisance to others.


Furthermore, Prescribed Conduct Rule 90(b) states that the Body Corporate is obliged to ensure members and occupiers do not use a section or exclusive use area so as to cause a nuisance.

In conclusion, dagga smoking (and the smoking of cigarettes) are allowed only inside a user’s unit, provided the smoke does not escape from the unit.
